Introduction
Welcome to Boek Nu. These Terms of Use ("Terms") govern your use of our mobile application ("App") and any related services provided by Boek Nu ("we," "us," or "our"). By using our App, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use our App.
Eligibility
You must be at least 18 years old to use our App. By using the App, you represent and warrant that you meet this age requirement.
Account Registration
To use certain features of the App, you may be required to create an account. When you create an account, you agree to:
- Provide accurate, current, and complete information.
- Maintain and promptly update your account information to keep it accurate, current, and complete.
- Keep your password confidential and secure.
- Notify us immediately of any unauthorized use of your account.
Use of the App
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the App in any way that violates any applicable local or international law or regulation.
- Exploit, harm, or attempt to exploit or harm minors in any way by exposing them to inappropriate content or otherwise.
- Transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
- Impersonate or attempt to impersonate Boek Nu, a Boek Nu employee, another user, or any other person or entity.
- Engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the App, or which, as determined by us, may harm Boek Nu or users of the App or expose them to liability.
Payments and Refunds
All payments made through the App are subject to our payment terms. We offer multiple payment gateways for your convenience. All sales are final, and we do not offer refunds unless required by law or specified otherwise in our policies.
Content and Intellectual Property
The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Boek Nu, its licensors, or other providers of such material and are protected by Trinidad and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial use. You must not:
- Modify copies of any materials from the App.
- Use any illustrations, photographs, video or audio sequences, or any graphics separately from the accompanying text.
- Delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from the App.
User Content
You may be allowed to submit content to the App, including but not limited to reviews, comments, and other content ("User Content"). You grant Boek Nu a non-exclusive, royalty-free, worldwide, transferable, sublicensable license to use, reproduce, distribute, prepare derivative works of, display, and perform all or any part of the User Content in connection with the App and our business.
You represent and warrant that:
- You own or control all rights in and to the User Content and have the right to grant the license granted above.
- All of your User Content does and will comply with these Terms.
Termination
We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms.
Limitation of Liability
In no event shall Boek Nu, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use of or inability to use the App; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the App; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our App by any third party; and/or (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the App, whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not we have been advised of the possibility of such damages.
Governing Law
These Terms shall be governed and construed in accordance with the laws of Trinidad and Tobago, without regard to its conflict of law provisions.
Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
